1. Acceptance of Terms

By accessing or using KompliTax (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. KompliTax is operated by Solomon Gababa (“we”, “our”, “us”).

2. Description of Service

KompliTax is a software-as-a-service platform that helps Kenyan businesses manage KRA eTIMS compliance, categorize transactions, generate tax reports, and create invoices. The Service is not a licensed tax advisory firm and does not provide regulated financial or legal advice.

3. Eligibility

You must be at least 18 years old and operate a business registered in Kenya to use the Service. By using the Service, you represent and warrant that you meet these requirements.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at hello@komplitax.co.ke of any unauthorized use.

5. Subscription and Billing

KompliTax offers Free, Starter, and Professional subscription tiers. Paid subscriptions are billed monthly in Kenyan Shillings (KES) via M-Pesa (powered by PayHero). Subscriptions renew automatically unless cancelled before the renewal date. Refunds are issued at our discretion.

6. Acceptable Use

You agree not to use the Service to: (a) upload false or fraudulent financial data; (b) circumvent KRA reporting obligations; (c) infringe on any third-party rights; (d) reverse-engineer or copy the Service; or (e) engage in any unlawful activity.

7. Disclaimer of Warranties

The Service is provided “as is” without warranty of any kind. We do not warrant that the Service will be error-free, uninterrupted, or that the tax calculations and compliance reports it produces are accurate or complete for your specific circumstances. Always verify critical tax information with a qualified tax professional.

8. Limitation of Liability

To the maximum extent permitted by Kenyan law, KompliTax shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service, including but not limited to KRA penalties, fines, or audit findings.

9. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
